46Public Holidays
46.1 Any day appointed under the Holidays Act 1983 (Qld), for the relevant University campus location and gazetted as such in the Queensland Government Gazette and/or the Queensland Government Industrial Gazette, shallwill be observed as a public holiday for the purposes of this Agreement.
46.2 Employees other than Casual employees Employees will be entitled to gazetted public holidays without loss of pay, including any other day or days gazetted in the State of Queensland, in addition to or substitution of any gazetted public holidays having application to the University of Queensland, provided that:
a. where Christmas Day falls on a Saturday or Sunday, the following Monday and Tuesday shallwill be observed as Christmas Day and Boxing Day respectively; or
b. where Boxing Day falls on a Saturday, the following Monday shallwill be observed as Boxing Day; and
c. where New Year’s Day falls on a Saturday or Sunday the following Monday shallwill be observed as New Year’s Day.
46.3 Where an employee has approval from the University to work in another State or Territory, they remain subject to Queensland gazetted public holidays and are not entitled to public holidays gazetted in any other State or Territory.
46.4 Where the gazetted Australia Day public holiday falls on an employee’s scheduled working day, theAn employee may substitute the annual Australia Day public holiday for an alternative day in the same calendar year, subject to genuine operational requirements and agreement with their Supervisor.
46.5 An employee that who requests, and receives approval, to work on the Australia Day Holiday under clause 46.4, is not entitled to the payment of overtime/penalty rates, and base rates of pay will apply to any ordinary hours worked on this day.
5646.6 Where an employee is a Shiftworker and a public holiday falls on thean employee’s rostered day off, that employee will receive:
a. another day off in lieu thereof; or
b. one (1) day shallwill be added to the employee’s Annual Leave balance; or
c. one (1) day’s pay, at ordinary rates, shallwill be paid in addition to the fortnightly pay.
46.7 Part-time Time employees Employees who usually work on a day of the week on which a public holiday falls and are not required to work on that day will be paid for the hours which would normally have been worked on that day.Where an employee is not a Shiftworker and a public holiday falls on a day where they are not scheduled to work, they will not receive any payment or additional day off in lieu.
46.8 No salary is payable for public holidays which occur during periods of leave without pay or unpaid leave.
46.9 An employee absent on personal/carer’s leave without pay on the working day immediately before and after a public holiday, will not receive salary for the public holiday.

46.346.4 Where the gazetted Australia Day public holiday falls on an e Full-Time or Part-Time Employee’s scheduled working day, theAn employee may substitute the annual Australia Day public holiday for an alternative day in the same calendar year, subject to genuine operational requirements and agreement with their Supervisor.

46.546.656Where a Full-Time or Part-Timen employee is a Shiftworker (as defined in clause 7.X) and a public holiday falls on thean employee’s rostered day off, that employee will may elect to receive either:
a. another day off in lieu thereof; or
b. one (1) day shallwill be added to the employee’s Annual Leave balance; or
c. one (1) day’s pay, at ordinary rates, shallwill be paid in addition to the fortnightly pay.

46.746.8 An employee’s working days will not be altered in order to attract or avoid a public holiday entitlement.
46.7Other than unpaid family and domestic violence leave, nNo salary willis be payable for public holidays which occur during periods of leave without pay or unpaid leave..
46.846.9An employee absent on personal/carer’s leave without pay on the working day immediately before and after a public holiday, will not receive salary for the public holiday.
