Professional Casual Conversion

14 Eligibility for Casual Professional Employee Conversion 

14.1 This provision only applies to Professional employeesEmployees

14.2 Casual employees Employees may apply for conversion to non-casual Casual employment Employment in accordance with the Fair Work Act.where prior to the request being made, they have been employed by the University for the past 6 months twelve (12) months and in the period of six (6) months prior to the request being made haveand worked on a regular and systematic basis. 

14.3 An application for conversion shall will not be unreasonably refused. Reasonable grounds for refusal are, but are not limited to, where the Casual employeeEmployee: 

  • is a student or has recently been a student, other than where their status as a student is irrelevant to their engagement and the work required; 

  • is a genuine retiree; 

  • is performing work which will either cease to be required or will be performed by a non-casual employee, within thirteen (13) weeks (from date of application); 

  • has a primary occupation with the University or elsewhere; 

  • does not meet the essential requirements of the position; and / or 

  • is performing work which is ad hoc, intermittent, unpredictable or involves hours that are irregular. 

14.4 An Casual employee Employee must not be engaged and re-engaged nor have their hours reduced in order to avoid any obligation under this clause. 

14.5 The University must determine an application for conversion either by offering conversion to non-casual Casual employment Employment or by rejecting the application. If the University rejects the application, it must provide written reasons for rejecting it. If the application is accepted, the employee will be offered a non-casual position.
