48. Personal/Carer’s Leave
48.1 Full-timeTime Professional and Academic employees Employees are entitled to access 72.5 hours (ten [10] working days) (cumulative) of paid personal/carer's leave per annum (pro-rata for Part-Time Employees) in any twelve (12) consecutive months of employment.
48.2 Casual Employees are entitled to unpaid Ppersonal/Ccarer’s Lleave in accordance with the National Employment Standards.
48.3 An employee is entitled to access personal leave when they are not fit for work due to personal illness or injury.
48.4 An employee is entitled to access carer’s leave for providing care ofr support to the employee’s dependent children, immediate or extended family or member of the employee’s household, because of a personal illness, personal injury or unexpected emergency affecting such persons.
48.5 An employee’s entitlement to personal/carer's leave accrues progressively during a year of service (other than periods of employment as a Casual Employee) according to the employee’s ordinary hours of work, and accumulates from year to year. Personal/carer’s leave will not be paid out upon termination of employment.
48.6 Unless otherwise agreed, paid personal/carer’s leave entitlements must be exhausted before an employee can access personal/carer’s leave without pay.
48.8 An employee absent on personal/carer’s leave without pay on the working days immediately before and after a public holiday will not receive salary for the public holiday.
48.9 Continuing and Fixed-term Academic employees Employees engaged on a continuous basis since the day immediately prior to approval of The University of Queensland Enterprise Agreement 2018-2021 will be entitled to a further thirty-five (35) days of paid personal (sick) leave per annum, non-cumulative. This additional leave can be used after the employee's cumulative personal/carer's leave (referred to in clause 48.1) is exhausted.
Casual employees are entitled to unpaid Personal/Carer’s Leave.
Personal leave accrues pro-rata from date of commencing duty.
48.5 Accumulated Personal/Carer’s leave The leave referred to in clauses 48.1 and 48.3 will not be paid out upon termination of employment.
48.6 An employee's entitlement to access cCarer’s Leave leave is available for providing care or support for the employee's is available for dependent children, immediate or extended family and significant others.
48.710 A medical certificate or statutory declarationEvidence is needed for instances of more than three (3) consecutive days of personal/carer's leave under the following conditions:.48.811 The University has the right to informmay, at any time, require a Part-Time Employee or Full-Time Employee an employee that in the event of to provide a medical certificate from a treating medical practitioner for any future absences on personal leave a medical certificate may be required.
For personal leave, this will include a medical certificate from the employee’s treating medical practitioner, or statutory declaration, which states the nature of the illness or injury and the period during which the employee will be unfit to work. The University reserves the right to request a medical clearance to return to work at the conclusion of the personal leave period.
For carer’s leave, this will include a medical certificate from the treating medical practitioner of the person requiring care, or a statutory declaration, which states the illness of the person requiring care or support, and confirmation that the illness is of such a nature that the employee is required to provide care or support.
48.11 The University may, at any time, require a Part-Time Employee or Full-Time Employee to provide a medical certificate from a treating medical practitioner for any future absences on personal leave .
48.12 For an employee whose partner is confirmed as pregnant, or where the birth of an employee’s child is by a legal surrogacy arrangement, the employee will be entitled to use any accrued Ccarer’s Lleave entitlement to attend appointment(s) directly related to the pregnancy. At the discretion of the Supervisor, the employee may be required to provide medical certificate(s) or a statutory declaration confirming the pregnancy and their attendance at the appointment(s).
49. Additional Carer’s Leave for All Employees
49.1 All employees, except Casual employees,Continuing and Fixed-Term Full-Time Employees who have : completed twelve (12) months of service ,
are entitled up to a maximum of 36.25 hours (five [5] working days) (pro rata for Part-Time Employees) additional carer’s leave per annum to look after an immediate family member of household member who is sick, injured, or affected by an unexpected emergencyprovide care for dependent children, immediate or extended family and significant others. This additional carer's leave does not accumulate from year to year and is not paid out on upon termination of employment.
49.2 A medical certificate or statutory declaration stating the illness of the person requiring care or support, and confirmation that the illness is of such a nature that the employee is required to provide care or support, is needed for instances of more than three (3) consecutive days of leave.
49.3 For an employee whose partner is confirmed as pregnant, or where the birth of an employee’s child is by a legal surrogacy arrangement, the employee will be entitled to access additional carer’s leave in clause 49.1 to attend appointments related to the pregnancy. At the direction of the Supervisor, the employee may be required to provide a medical certificate or a statutory declaration confirming the pregnancy and attendance at the appointment(s).

48.148.5An employee’s entitlement to personal/carer's leave accrues progressively during a year of service (other than periods of employment as a Casual Employee) according to the employee’s ordinary hours of work, and accumulates from year to year. Personal/carer’s leave will not be paid out upon termination of employment.
48.248.6Unless otherwise agreed, paid personal/carer’s leave entitlements must be exhausted before an employee can access personal/carer’s leave without pay.

For personal leave, this will include a medical certificate from the employee’s treating medical practitioner, or statutory declaration, which states the nature of the illness or injury and the period during which the employee will be unfit to work. The University reserves the right to request a medical clearance to return to work at the conclusion of the personal leave period.
b. For carer’s leave, this will include a medical certificate from the treating medical practitioner of the person requiring care or support, or a statutory declaration, which states the illness of the person requiring care or support, and confirmation that the illness or injury of the person is of such a nature that the employee is required to provide care or support, and the period during which the employee will be required to provide care or support.
48.10 Where there are workplace health and safety concerns, the University reserves the right to request a medical clearance to return to work at the conclusion of the personal leave period.
48.118The University has the right to informmay, at any time, require that a Part-Time Employee or Full-Time Employee an employee that in the event of n employee to provide a medical certificate from a treating medical practitioner for any future absences on personal leave, such as where there is a pattern of absences or the University holds workplace health and safety concerns a medical certificate may be required.
48.648.12For an employee whose partner is confirmed as pregnant, or where the birth of an employee’s child is by a legal surrogacy arrangement, the employee will be entitled to use any accrued Ccarer’s Lleave entitlement to attend appointment(s) directly related to the pregnancy. At the discretion of the Supervisor, the employee may be required to provide medical certificate(s) or a statutory declaration confirming the pregnancy and their attendance at the appointment(s).
49 Additional Carer’s Leave for All Employees
All employees, except Casual employees,Continuing and Fixed-Term Full-Time Employees who have:completed twelve (12) months of service,
49.1 are entitled up to a maximum of 36.25 hours (five [5] working days) (pro rata for Part-Time Employees) paid additional carer’s leave per annum to look after an immediate family member of household member who is sick, injured, or affected by an unexpected emergencyfor the purpose set out in clause 48.348.4provide care for dependent children, immediate or extended family and significant others.
49.149.2 This additional carer's leave does not accumulate from year to year and is not paid out on upon termination of employment.
49.249.3An employee who is absent A medical certificate or statutory declaration stating the illness of the person requiring care or support, and confirmation that the illness is of such a nature that the employee is required to provide care or support, is needed for instances of more than three (3) consecutive days of leave.Evidence is needed for instances of more than 3 consecutive days of carer's leave will be required to provide evidence in accordance with clause 48.8(b).
49.349.4 For an employee whose partner is confirmed as pregnant, or where the birth of an employee’s child is by a legal surrogacy arrangement, the employee will be entitled to access additional carer’s leave in clause 49.1to attend appointments related to the pregnancy. At the direction of the Supervisor, the employee may be required to provide a medical certificate or a statutory declaration confirming the pregnancy and attendance at the appointment(s).
