Leave Without Pay
55 Leave Without Pay orand Unpaid Leave
An employee on lLeave Without without Pay pay in excess of three (3)3 months shallwill not accrue leave entitlements.
55.1 Absence on a period of approved Leave leave Without without Pay pay will not affect an employee’s continuous service Absence on a period of approved leave without pay nor will notit count towards the service period for the purposes of accrual of credits toward an Special StudiesAcademic Enrichment Program (or any replacement).
55.2 An employee on any form of leave without pay or unpaid leave in a continuous period exceeding 3 months will not accrue paid leave entitlements.
55.3 An employee must return to work for a minimum of 4 weeks following an approved period of leave without pay or unpaid leave to be eligible to apply for a subsequent period of leave without pay or unpaid leave. This does not exempt orf exclude an employee from requesting an extension to a current period of leave without pay or unpaid leave.
55.4 Leave without pay or unpaid leave will not be approved in broken periods separated by public holidays, annual leave or long service leave.
55.5 An employee on any form of leave without pay or unpaid leave will not receive:
a. employer superannuation contributions; or
b. salary for public holidays which fall during the period leave without pay or unpaid leave.
55.6 Unless otherwise approved, an employee will be required to exhaust annual leave and long service leave entitlements prior to commencing leave without pay.
55.7 An employee who has, during a 12 month period, been absent in excess of 3 months on leave without pay in aggregate, shall have the increment date and any resultant increase delayed by the period of absence.
Unpaid Parental Leave
55.8 An employee on unpaid parental leave in a continuous period exceeding 12 months will not accrue paid leave entitlements.
55.9 An employee on any period of unpaid parental leave will not receive:
a. employer superannuation contributions; or
b. salary for public holidays which fall during the period leave without pay or unpaid leave.
