4 Application of the Agreement
4.1 This Agreement has been negotiated between the University and UQ College Limited, and bargaining representatives on behalf of employees (including the Unions listed below) and shall will be binding according to its terms upon the following:
The the University;
Academic employees Employees employed by the University as defined in clause 7.17.X;
Professional employees Employees employed by the University and UQ College Limited as defined in clause 7.347.X;
UQ College Limited;
TESOL Language Teachers employed by UQ College Limited as defined in clause 7.X;
The the National Tertiary Education Industry Union ("NTEU"); and
The the Australian Municipal, Administrative, Clerical and Services Union ("ASU/Together").
4.2 This Agreement shall appliesy to all Academic, and Professional employees and TESOL Language Teacher Employees employed by the University and/or UQ College Limited, but does not apply to Excluded Employees. However, where an employee is covered by one of the schedules below, that schedule applies to the extent of any inconsistency with the remaining terms of the Agreement:

7 Definitions
7.X “Academic employeeEmployee”:
means all persons:
means all persons employed by the University in a position classified in accordance with the descriptors in Schedule 2 (– Academic Level Descriptions) or Schedule 5 (– Duties and Pay Calculation of Casual Casual Academic Employees); and
, or a person employed under a Casual Casual employment Employment arrangement to carry out academic duties; but
, but does not include Excluded Employees. a person who is the Vice-Chancellor and President, the Provost, the Deputy Provost, a Deputy-Vice-Chancellor, a Pro-Vice-Chancellor, or equivalent senior management positions as created from time to time.
7.X "Excluded Employees" means:
a person who is the Vice-Chancellor and President, the Provost, the Deputy Provost, a Deputy-Vice-Chancellor, a Vice-President, Deputy Vice-President, an Executive Dean, Deputy Dean, a University-level Institute Director, Deputy Institute Director, a Pro-Vice-Chancellor;
thean Executive Dean, Deputy Executive Dean, or Institute Director, Deputy Institute DirectorDirector and Deputy Director of University Institutes;
the Chief Operating Officer, a Chief Executive Officer, a Chief Officer, a Director, Deputy Director, or Associate Director;
equivalent senior management positions (howsoever named) as created from time to time; andor
employees holding similar or equivalent offices who arepositions classified above HEW Level 9. 0.
7.X “Professional Employee”:
means all persons:
employed in a position classified in accordance with the position descriptors in Schedule 6 Schedule X – Classification Structure and Job Descriptors for Professional Employees; or
designated as Research Assistants; and
includes employees who are above HEW Level 9 if the employee was appointed to a position above HEW Level 9 as at 30 October 2014. Such employees will continue to be covered by the terms of this Agreement and by the terms of any individual contractual agreements until such time as their existing contract expires (where relevant) or ends or their conditions of employment are renegotiated between the employee and the University); but
does not include Excluded Employees.
Customs House employees, but
does not mean or include:
a person who is the Vice-Chancellor and President, the Provost, Chief Operating Officer, the Deputy Provost, a Deputy Vice-Chancellor, Pro-Vice-Chancellor, Director, a Deputy Director, Associate Director or equivalent senior manager (howsoever named) of a unit of the University’s Administration or Information Services; or
employees holding similar or equivalent offices who are above HEW Level 9, unless the employee was appointed to a position above HEW Level 9 as at the date of approval of The University of Queensland Enterprise Agreement 2014 – 2017 by the FWC (30 October 2014). (Such employees will continue to be covered by the terms of this Agreement and by the terms of any individual contractual agreements until such time as their existing contract expires (where relevant) or their conditions of employment are renegotiated between the employee and the University).
7.X “TESOL Language Teacher” means a suitably qualified staff member engaged to conduct, teach, prepare and assess English language and TESOL methodology classes, and to perform other duties including:
Development of shared teaching and learning materials;
Course curriculum/syllabus design;
Student assessment, placement and exit interviews, test invigilation, marking and recording of results;
Writing student reports;
Classroom teaching observation by preservice trainee teachers and in-service teachers;
Participation in arrival orientation, student consultation and supervision of student activities;
Ongoing participation in continuing professional development and general course administration.
but does not include Excluded Employees.
