51. Cultural Leave
a. Aboriginal and Torres Strait Islander employees will be entitled to ten (10) days paid cultural leave and ten (10) days unpaid cCultural Lleave per 12-month period for the purpose of fulfilling cultural obligations.
To fulfill unique Aboriginal and Torres Strait Islander cultural responsibilities, the University supports Aboriginal or Torres Strait Islander employees by providing Continuing and Fixed-Term Aboriginal or Torres Strait Islander employees are entitled to access: to
eight (8) days of paid Aboriginal and Torres Strait Islander cultural leave annually in any 12-month period (in addition to the personal/carer’s leave provisions); and
ten (10) days of unpaid Aboriginal and Torres Strait Islander cultural leave in any 12-month period.
b. Aboriginal and Torres Strait Islander cultural leave in accordance with this clause is not cumulative. Such obligations may be traditional or urban in nature and include but are not limited to initiation, birthing and naming, sSorry bBusiness, Sorry Day, undertaking lore, smoking or cleansing, sacred site or land ceremonies, community organisation business, Native Title business, providing Welcomes and ceremonial items for external events, National Aboriginal and Islander Day Observation Committee (NAIDOC) Week functions, Reconciliation week, Festival of Light, Tomb Opening and other relevant cultural events.
c. An eligible employee may elect to use annual leave in lieu of any unpaid leave granted in accordance with Cultural Leave provisions.
d. Cultural leave in accordance with this clause does not accumulate from year to year and is not paid out upon termination of employment.
e. Cultural leave is available from the commencement of employment and on the available in full at the start of each 12-month periodanniversary of the employee’s employment.
f. Cultural leave can may be taken as a single continuous 10-day period; or separate periods of one or more days each; or any separate periods as agreed, including periods of less than one day.
