Annual Leave
47.1 Full-Time Employees will be entitled to 145 hours of paid annual leave for each 12 months of continuous paid service (pro-rata for Part-Time Employees).
47.2 Full-Time Employees who are Continuous Shiftworkers will be entitled to 181 hours and 15 minutes for each 12 months of continuous paid service. Continuous Shiftworkers are shiftworkers for the purpose of the National Employment Standards (pro-rata for Part-Time Employees).
47.3 An employee’s entitlement to paid annual leave accrues progressively during a year of service (other than periods of employment as a Casual Employee) according to the employee’s ordinary hours of work and accumulates from year to year. Accrued annual leave is paid out on termination of employment.
47.4 It is expected that all annual leave will ordinarily be taken within 12 months of accrual.
47.5 Subject to operational requirements and clause X and X, as far as reasonably practicable, leave should be taken at a time which is convenient to the employee.
47.6 An employee will be required to submit a request for annual leave at least 1 month prior to the proposed commencement of the period of leave, unless otherwise approved by the University.
47.7 An employee who moves from one University position to another will ordinarily be expected to take all their accrued annual leave prior to the commencement of the new position.
47.8 Annual leave is exclusive of public holidays and non-working days for employees with a flexible work arrangement. Annual leave is exclusive of rostered days off for Full-Time Employees and Part-Time Employees who are Continuous Shiftworkers or Shiftworkers.
47.9 An employee who becomes ill unexpectedly during a period of annual leave may request to access personal leave for the period of the illness. A medical certificate must be submitted covering the period of illness for consideration by the University.
47.10 Fixed-Term Employees will ordinarily be expected to take their accrued annual leave prior to the expiration of their contract, unless otherwise approved by the University.
47.11 Direction to take annual leave:
Annual
leave that is accrued in excess of 290 hours for Full-Time Employees and 362.5 hours for shiftworkers (pro-rata for Part-Time Employees) will be considered as excess leave for the purposes of this clause (Excess Leave).
Where an employee has Excess Leave, the University may direct an employee to take annual leave as follows (pro-rata for Part-Time Employees):
Accrual of 435 hours of leave or more – up to 217.5 hours leave.
Accrual of 362.5 to 435 hours of leave – up to 181.25 hours leave.
Accrual of 290 to 362.5 hours of leave – up to 145 hours leave.
Where an employee has Excess Leave, the employee may apply to cash out up to 50% of the annual leave they have been directed to take, provided that after the cash out the employee will have at least 145 hours of annual leave remaining.
Each cashing out of a particular amount of annual leave must be by a separate agreement in writing between the University and the employee. The employee must be paid at least the full amount that would have been payable to the employee had the employee taken the annual leave that the employee has forgone.
Where the University directs an employee to take annual leave, the Supervisor will:
discuss the timing of the leave with the employee allowing the employee, subject to operational requirements, an opportunity to take an appropriate amount of leave at a time convenient to the employee;
allow the employee to take leave in one or more blocks if the employee wishes to do so; and
provide the employee with reasonable notice of the leave to be taken.
Where an employee has been approved for cashing out a portion of a direction to take excess annual leave, this cashed out portion (to be paid at the time of taking the remainder of directed leave portion), will be regarded to be part of that direction, except where an employee applies to cancel the leave and approval is granted.
Nothing in this clause prevents an employee who has Excess Leave from applying to cash out annual leave provided that after the cash out the employee will have at least 145 hours of annual leave remaining.
Annual Leave Loading
47.12 This clause does not apply to Casual Employees.
47.13 Annual leave loading for all employees will equate to 17.5% of ordinary salary, except where shift or penalty payments would be greater, with a maximum payment equal to the Australian Bureau of Statistics’ average weekly total earnings of all males (Australia) for the period preceding the date of accrual.
47.14 Unless an employee has an agreed Individual Flexibility Arrangement relating to the payment of annual leave loading, annual leave loading will be paid to:
Eligible Academic Employees once per year; and
Eligible Professional Employees at the time when a period of annual leave is taken.
